Vierter m\u00f6glicher Unwirksamkeitsgrund eines Priorit\u00e4tsrechts: Nicht alle Formerfordernisse f\u00fcr die Beanspruchung der Priorit\u00e4t wurden erf\u00fcllt

Obgleich die Pariser Verbands\u00fcbereinkunft PV\u00dc<\/a> die Formerfordernisse f\u00fcr Priorit\u00e4tsrecht beschr\u00e4nkt, welche unter nationalem Recht f\u00fcr die Beanspruchung der Priorit\u00e4t gefordert werden k\u00f6nnen, \u00fcberl\u00e4sst die Pariser Verbands\u00fcbereinkunft gewisse Formerfordernisse nationalem Recht. Innerhalb bestimmter Fristen, welche nach nationalem Recht geregelt sind, m\u00fcssen \u00fcblicherweise die folgenden Formerfordernisse erf\u00fcllt werden:<\/p>\n\n\n\n

    \n
  1. Das Datum und Land der priorit\u00e4tsbegr\u00fcndenden ersten Hinterlegung muss erkl\u00e4rt werden<\/li>\n\n\n\n
  2. Die Anmeldenummer der priorit\u00e4tsbegr\u00fcndenden Anmeldung muss angegeben werden<\/li>\n\n\n\n
  3. Eine Kopie der priorit\u00e4tsbegr\u00fcndenden Anmeldung muss eingereicht werden, in vielen L\u00e4ndern in Form einer beglaubigten Kopie, oft auch kurz \u201cPriorit\u00e4tsdokument\u201c genannt. Einige Patent- und Marken\u00e4mter haben sich gegenseitig auf einen elektronischen Austausch von Priorit\u00e4tsdokumenten (PDX) geeinigt, anstatt ein Papier-Priorit\u00e4tsdokument zu fordern, sofern die Anmelderin den elektronischen Austausch des Priorit\u00e4tsdokuments autorisiert.<\/li>\n<\/ol>\n\n\n\n
